not every tourist stays at the beach , while visiting fl a lot of tourist stay a little inland and take a short drive to the beach,but mr finberg wants to only pay the the tourist that stay across from the beach, what about the rest of us that rather save a little money and take a short drive to the beach , i quess it doesnt matter because we had no tourists this year anyway mr finberg should look at the big picture, a claim with documention shoul be paid even if it is not across from the beach………………………………………….
I agree, Pat. The entire state of Florida took a hit. I believe Kenneth Feinberg is looking for ways to limit BP’s liability.
Lies and broken promises that is all that has come out of this “new and Improved” process. It has been nearly 2 months since we filed and the only answer we are able to get from the so called helpful people at the claims center is that they have no answers. I suppose it would have been easier for us to file a lawsuit against everyone involved. As a result of the closing of the fishing grounds and the slow process we have been forced to close our business and move our boat to Texas. We have not asked for more then what we would have been able to do during a normal fishing season. I wish the media would still look at the little guy and not forget about us.
Nick, I am hearing from so many people with stories like yours. We are seeing a disaster just as huge as the original oil spill, but there’s no gushing oil well so it’s not getting covered like the oil spill did. We’re trying to do our part to keep your situation before the public. BP would like nothing better than for everyone to forget about you so they can jerk you around. BP knows that people who are in desperate circumstances will usually take less money than those who are okay.
how about the first claims to go into the gccf and we are still waiting after 60 days now, i found out where the adjusters are at and who is the company hired by kenneth feinberg and have his office number now, i know this cause for 45 days under review i called the adjusters in virginia and one hour my claim changed to need more info and they had that info already in hand just a ploy to tell me to back off or they will hold back even longer then they have now. so you see its not right we have been waiting and people that just filed a week ago are being paid right now and now they took off the payment stats so we can not see who they are paying and not paying.

Has anyone noticed that the local and national media does not run stories about the FAILURES of the CLAIMS PROCESS? Do you know why? Every week BP spends millions blanketing newspapers, TV, and radio in advertising. These media outlets WILL NOT say anything adverse because of the HUGE revenue stream it is getting from BP.
I wish BP,GCCF was fair about paying people that lost money.its not right, u all ctould still make this right.. its very upseting to know whats going on. I wish i had something good to say. Please make it right.
I’ve had to tell my daughter that no birthday in august because daddy isn’t working like he use to and now Christmas is around the corner and i dread telling all 3 of my children that Santa might not come because GCCF is stalling and prolonging their part in this claims process.it all started with GCCF’s local agent here in Panama City Beach filing my claim for 2500.00 when i told him 7500.00 then i fought since September 25,2010 till present on the miss filing and was told to fix it was to file a final claim ,so i did and have been given the run around since Sept. first story was re-reviewing emergency claims ,if you don’t here from GCCF by Oct.11,2010 call us(GCCF) back ,so i did, then it was no that’s the week of the 11th if you don’t here from us(GCCF) by that Saturday then call us, so i did ,then GCCF stated well we’re backed up so give us(GCCF) a couple weeks ,so i did and then it was Nov. 23,2010, that date came and went,Now its Dec.15,2010 (supposed start date for final claims) but with my experience with GCCF that date will change just like they(GCCF)keep changing the protocols as they go … for a company (Garden City Group) that is Number one in the Administrator role the protocols & Procedures should have been in place before they(GCCF) started the claims Process. please if you can help with my claim or just to get the REAL STORY OUT TO THE PEOPLE,SO they can see what is really happening with the “LITTLE PEOPLE” of the Gulf of Mexico’s claims ,and how they’re really being handled. e-mail me any and all news reporters Michaeljgrantjr@live.com
BP happilly boasted that if you accept the Quick Pay option that you will receive 5,000 for individuals and 25,000 for businesses without ant further documentations. THIS IS TOTALLY FALSE. Where infact my husband is stiil waiting and it will be 30 days on the 29th of the month, and as of yet not received a payment . When asked why? They tell you that they don’t know why ? Isn’t that false advertising?
In my opinion Feinburg SUX. i live in P.C.B. Florida and I have been trying for over a year to get something out of them. The only thing i have gotten is DENIAL letters. First the lost some of my information and said i needed to resend. Second they said I didnt prove my losses. Third they said i proved my losses but didnt prove that I lost it because of the OIL SPILL. I am really not understanding this. I work at a high rise on the beach and we had people canceling reservations left and right because of THE SPILL. I also cleaned condos at Bay Point and the biggest fishing tournament of the year…The Billfish Inventational….had to be canceled because the waters were closed to fishing. I may not be the brightest crayon in the box but I know it doesnt take a rocket scientist to figure out if you live in a tourist community and your line of work depends on our tourist and they start canceling that you lose money. Maybe Feinberg needs to go on the show Undercover Boss and see just how hard it is in the different fields that depend on our tourist. Im pretty sure his family is being taking care of while mine is still suffering. I just want this to be over and get what I think I deserve!!!!!!!
A business that I worked at closed and I helped several of our employees file claims as many needed help with the process. One person filed an interim claim and review ten times and every single time they got a different response, none of which were according to the proper methodology. Or my favorite was one person who filed an interim claim and after a couple of times they finally calculated it properly, The next quarter they screwed it up again, but fixed it on review, The next quarter they reverted back to denying the claim and refused to fix it on review, BUT you can still get the final offer they gave you the last time? SO how is it that you can tell someone that their claim is now worth 0.00 and they never should of got a penny, but keep what we gave you and we will still honor the previous final payment. That just shows you how they blow smoke up your a$$ to try and get rid of you after a while. Its either wrong or its right, there is only one methodology in place at a given time so you can’t have it both ways. Oh, and my favorite example of the level of education, or lack thereof, you are dealing with when you call in… they had requested proof of gross ytd income as of end of april 2010 and proof of total income in 2010. They were provided with both the W2 and the taxes for 2010 to prove total income. For proof of income as of April 2010 they were given four documents including the last paystub of April that showed gross ytd earnings, two employer payroll documents for that payperiod that showed gross ytd earnings AND a letter from the employer that dictated the same and confirmed the documents. After previously calculating projected 2010 income properly for two interim claims on the third the income was 1/4 of what was previously projected (due to applying their seasonality percentages to the total income of the year for jan-april instead of using ACTUAL earnings of jan-april as documented on the 4 documents just listed which of course also was done to the remainder of the year and totally through the claim off by thousands) so we called because on review they still did not correct it. The lady told us that the reason it had been changed was because they didn’t have proof of income for the entire year. When all the documentation was brought up, she found it, reviewed it, and then said that they needed every paystub for the entire year in order to change it back to the way it was previously (properly) calculated. I told the woman that if you have four documents proving jan-april income all you have to do is multiply it by 3 to project annual income as done for all claims and that a w2 and taxes proving total income would mean that all you have to do is subtract one from the other to see what was made for may-december (we are talking common sense here not some major mathematical equation). The lady instisted that this could not be done and while she “could see my point” they are unable to do this “because hourly employees, especially tipped employees, can make different amounts of money every week so we can’t figure out how much that is without every paystub because it could be more than what it comes to by subtracting april’s income from the income shown on the tax statement.” SERIOUSLY? The only way that is possible is if I am committing tax fraud by not claiming all of my income. SHE COULD NOT GRASP THE CONCEPT! Who are these people actually working on these claims did they steal the employees that work for verizon and tmobile? And unfortunately, when the claim was resubmitted they had just changed the rules for FL alliance counties and because our restuarant that was 8 miles from the acutal beach, but surrounded by rv parks, vacation rentals, and motels, that depended 75% on tourists was not found to have been closed in connection with the oil spill. Even though the business oweners were paid, but again we will still honor that last final offer we gave you, which you really aren’t entitled to, so take it and leave us alone!!!!!!!!!!!!!!!! I could write for hours about all of the horrors that the GCCF is made of. I only hope that the company auditing the claims appointed by the governement combs through every single claim so it is officially on record what a crock of sh$$ it was and because any claims found not to have been correct under the stated methodology are to be corrected and paid properly. Hopefully the auditors are impartial and thorough becuase there are thousands that finally took the payment and left because it was a losing battle and they were desperate for whatever they could get to feed their children and save their homes and they deserve to at least get what they were supposed to by the GCCF’s own rules. Which brings me to what I will try very hard to be my last point….December 2010 the almighty quick pay scam! You have desperate people that have been getting yanked around for months and months and the THEN SUPPOSED NEUTRAL Feinberg dangles the quick pay carrot basically telling people that it was no strings sign a release and get the check and its really great becasue then you are not going to have to send us in alot more documentation and try to prove everything to get whatever we give you. People had been sending in hundreds of pages of documents, two and three times no less, and getting a tenth of what they were owed and its the holidays and many were behind on every bill and here comes this measley few thousand dollars to those who need and deserve much more, but they are desperate and intimidated on what more documentation are they possibly going to have to come up with after months of fighting with BP and the GCCF and hey Feinberg isn’t working for BP or anything so they take it only to find out that the interim process was much more fair than the emergency program (which isn’t saying much) and they would of got ten times more had they held out til February to find out the new rules, but then again they would have been living under a bridge by February. So they got screwed and then to add salt to the wound FEINBERG IS FOUND TO BE WORKING FOR BP! Anyone that signed a release before Feinberg had to admit he was working to protect BP by the court deserves that release to be null and void. It was under false pretenses, it was purposely put out to make people go away for peanuts knowing they were desperate, and those are the people who need the money more than anyone. Now the court program is taking over and it is proclaimed to be neutral, which I believe, and it is said that the people that qualify under the class to go through the court program are going to get much more money than anyone ever did from the GCCF. So, as usual in this country, the rich get richer and the poor got poorer. Those that had the means to hold out all this time will now get a fair and balanced approach and a payout as large as they deserve, but those who were desperate after months of no income and couldn’t hold out get nothing more than a too bad, so sad! I have heard rumors of some lawyers gathering clients to try and fight the GCCF release for a variey of reasons and for the sake of thousands, especially those pulled into the quick pay before the judge ruled Feinberg to be a BP monster, I hope and pray it happens! But, hey Kenny boy, keep patting yourself on the back for a job well done and go write your book, but if you want anybody to buy it you really need to tell the real story on how you led a team of people who couldn’t calculate 2×2, had no idea about half of the so called rules listed on the website, or would say I can’t help what the website says thats not how we do it, and only knew one thing under your leadership: DENY as many as possible, pay as little as possible, and don’t bother me why I go cash my big fat paycheck becasue I will be laughing all the way to the bank!
